When this happens it's usually it's because it's not your prescription. All controlled medications or substances require a prescription and every prescription is required to carry the name of the person it's intended for.

It is indeed a crime, regardless of how big or small a crime you personally consider it to be. Had you or I been caught doing this we'd have been charged with a violation of the law and most likely arrested. But not good ol' Rush.
