It definitely is the teacher's aide that should be questioned, not the 4-year old child.

The teacher's aide certainly has issues, and so does the La Vega administration which still insists on keeping, "inappropriate physical contact" in the child's records. These people show a twisted sense of judgment. Things like this are why I've always hated authority -- it attracts a disproportionate number of bullies, sadists, and, in positions of authority over children, sexual deviants such as that teacher's aide, her deviancy is acted out in a psychological way, though it still seems to be a variation of pedophilia (was she a victim of abuse?). 4 years old is still practically a baby. What he experienced is child abuse, subjecting him that kind of deviancy and extremism. In fact, I believe the parents should sue the school for subjecting their child to psychological abuse of a sexual nature.
